Reselling an off-plan property before handover in Dubai: conditions and cautions

Léonard Arzouni · 24 September 2026
Some investors buy off-plan intending to resell before handover, to realise a capital gain. This is possible in Dubai, but regulated.
The principle
Reselling an off-plan property means transferring one's rights and obligations under the sale contract to a third party. This is known as an "assignment". The new buyer takes over the payment plan from where it stands.
What the rules require
Conditions depend on the developer and the project, but generally include:
- A minimum percentage of the price already paid before a resale is allowed.
- The developer's written approval, often through a no-objection certificate (NOC).
- Payment of administrative and transfer fees to the developer and the Dubai Land Department.
- Updating the off-plan sales register.
How the transaction is organised
The seller and buyer agree on a price that reflects amounts already paid and the targeted capital gain. The buyer pays the seller the difference and takes over the remaining instalments. The operation takes place with the support of the developer and the registration services.
Points of caution
- Check the assignment conditions in the contract even before buying.
- Factor in assignment fees when calculating the capital gain.
- Do not assume the market will be a ready buyer: liquidity depends on the project and the timing.
- Have a plan B if a resale is not possible: keeping the property until handover should remain financially viable.
What is the right timing?
Selling early avoids future instalments but limits the capital gain; selling close to handover can better value the property, with market risk closer to the deadline.
A capital gain is never guaranteed
A project may appreciate, but it may also stagnate. Deciding on an off-plan purchase with the sole aim of a short-term resale exposes you to a risk that needs to be measured.
